2023 EUROVISION SONG CONTEST SWISS REGULATIONS

Date: July 12 th 2022

SRF, RTS, RSI and RTR (referred to in the regulations as ‘SRG SSR’) are working together to find the Swiss song and artist for the 2023 Eurovision Song Contest. Applications will be accepted between August 25 th , 2022, and September 8 th , 2022 (deadline 10pm).

GENERAL TERMS AND CONDITIONS FOR ENTERING
1. SRG SSR is looking for a contemporary song that has international appeal and will stand out. The lyrics should have a strong, clear and easily understood message.

2. Applications must be submitted with an audio file via the official SRG SSR platform. (srf.ch/eurovision)

3. The application and song can only by uploaded by the holder of the copyright. A maximum of five songs can be submitted by any one copyright holder. By uploading the song, entrants confirm that all copyright holders agree to it being submitted and that there is nothing to prevent them from entering the Swiss selection process and taking part in the Eurovision Song Contest.

4. By uploading the song, all copyright holders accept the terms of the Swiss regulations and the EBU’s international regulations for the Eurovision Song Contest.

5. Commercial and religious organisations, non-profit organisations and foundations are not permitted to take part.

6. The copyright holders guarantee that the composition and use of the work and its production and performance do not contravene any agreements with third parties, for example with record labels, managers, promoters or agencies. The copyright holders indemnify SRG SSR against any claims by third parties, without any limitation in terms of time, place or subject matter.

7. Songs that have been submitted cannot be withdrawn at a later date.

THE SELECTION PROCESS
8. All songs that are submitted will be checked and assessed by editors. Songs that do not meet the quality standard or do not comply with these regulations will be eliminated. Then the final selection of songs and artists will be made in a number of stages by a panel of 100 viewers and an international jury of 20 music professionals.

9. Any attempts at manipulation or bribery, or irregularities during voting by the panel and the jury, may lead to the song, its performer(s) and member(s) of the panel or jury being disqualified.

SUGGESTIONS FOR THEMATIC CONTENT OR CONCEPTUAL SONGS
10. At the Eurovision Song Contest, it is partly a question of addressing certain themes which will stir the emotions of viewers and jurors. We therefore encourage composers and songwriters also to submit songs about themes that reflect current events or those whose content will evoke an emotional reaction or a feeling of recognition in the ESC audience.

CONDITIONS FOR THE SONG
11. By submitting their application, copyright holders confirm that the song they are entering is their own work (composition/lyrics) and not plagiarised in any way.

12. The holders of the copyright for the song must comply with the EBU’s licensing terms. These form part of the regulations for the Eurovision Song Contest.

13. The song that is submitted must not last longer than three minutes.

14. Songs may be submitted with words in any language.

15. The song must not contain any political, racist or violent words.

16. Instrumental versions are not permitted. Every title must include sung or spoken passages.

17. Songs may also be submitted for which a performer has not yet been identified. However, in such a case the application must include a demo voice singing the song.

18. All applicants will be notified of the outcome of the selection process by the end of 2022.

19. Songs that do not qualify will not be published by SRG SSR.

20. SRG SSR can, at its discretion, ask for the production or lyrics of the song to be modified for quality reasons and it has sole decision-making authority in this respect.

CONDITIONS FOR THE PERFORMER
21. The performers accept all the regulations associated with the Eurovision Song Contest.

22. No performer may represent more than one country in the Eurovision Song Contest.

23. If two entrants score equal points, preference will be given to performers who are Swiss citizens or who are resident in Switzerland. However, nationality is not a deciding factor and does not prohibit anyone from entering a song.

24. The minimum age for performers is 16 (as of 1.5.2023).

25. Since songs can also be submitted with demo voices, it must be stated when they are uploaded whether or not the performer wants to take part in the competition.

26. The performers, and therefore the voice singing the song, may be replaced by SRG SSR for quality reasons at any stage during the selection process. SRG SSR makes the final decision as to which performers sing which songs.

27. Participation in the contest by the winner of the Swiss selection process for the Eurovision Song Contest will be governed by a written contract.

28. Performers must be available from January 2023 for rehearsals and in March/April 2023 for promotional events and rehearsals.

29. By signing the agreement, performers commit themselves to performing the song, thus representing Switzerland, at the 2023 Eurovision Song Contest. The international semi-final broadcasts and the international final are expected to take place in May 2023. The period of compulsory attendance at the venue will last for about two weeks and will depend on the EBU’s rehearsal schedule.

LIVE SHOWS AT THE EUROVISION SONG CONTEST
30. The performers will present their song live. It is currently assumed that the backing vocals can be either pre-recorded or live (as in 2022). The decision as to which option to choose rests solely with SRG SSR.

31. The song can be performed by one or more singers/musicians. However, no more than six people (including dancers/musicians/backing vocals) may be present on the stage.

32. All instruments are pre-recorded.

33. No animals are allowed on stage.

34. Political, racist or violent statements, gestures or symbols are not permitted.

35. SRG SSR has sole decision-making authority on staging and creative direction. Staging includes dress, choreography, lighting and LED screen content.

ADDITIONAL PROVISIONS
36. The EBU publishes the international regulations for the Eurovision Song Contest. If the international regulations differ from national regulations, the international regulations apply. All regulations governing participation in the semi-final or final of the 2023 Eurovision Song Contest are defined in this document and are binding on the winner of the national selection process.

37. Entries that are in breach of national or international regulations will be disqualified by SRG SSR or the EBU.

38. SRG SSR reserves the right to make any necessary changes to the selection process or the regulations at any time in order to meet the required quality standards.

39. Right of use: SRG SSR can use the piece chosen as the final Swiss entry to the European Song Contest free of charge on all channels (radio, TV, internet, social media, etc.) without any conditions or restrictions.

40. Copyright: The holders of the copyright for the song reserve their rights to it at all times, as calculated by the licensing bodies (e.g. SUISA).

41. The song must not be published in full or in part before 1.9.2022 (on radio, TV, internet, live public performances, recordings, etc.). The date for publishing and announcing the Swiss entry (including the song title, performer and composer/lyricist) will be decided by SRG SSR.

42. SRG SSR reserves the right to amend these regulations at any time or modify them to comply with the international regulations. No claims by participants arising from changes to the regulations will be accepted.

43. There is no right of appeal.

44. The German version of the regulations has legal force.
